Supreme Court: CHRT Can't Impose Costs. Says Nothing About Constitutionality of Sec. 13

A number of bloggers, as we did ourselves, opined that when the Lemire case makes it to the Supreme Court, the financial penalty part would be dropped but that Sec. 13 of the Human Rights Act would be itself found to be constitutional. While we can't be certain how the Court will finally rule when presented with the Lemire case, this recent decision appears to reinforce this belief:

In a case involving a sexual harassment complaint, the Supreme Court of Canada has ruled that the Canadian Human Rights Tribunal does not have the authority to award legal costs.

CHRC Appeal on Tremaine Contempt Decision Successful

Back in November 2010, Terry Tremaine managed to avoid contempt charges due to his violation of the CHRT decision against him as a result of a technicality. That decision was appealed by the CHRC in December. Today, the Federal Court of Appeal overturned the Federal Court's original decision that Terry Tremaine was not in contempt of court for not removing postings and making new ones contrary to the CHRT order against him.  The case has now been returned it back to the Federal Court for sentencing.


The decision wasn't unanimous, but the reasons are provided in an additional document:

Quebec Boneheads. The More Things Change, the More Things Stay the Same

 
Boneheads in Quebec are, sadly, well represented in our timeline of racially-based violence that we published earlier in the month. One of those individuals, Steve Legault's (on the left in the photo above) name has once again come into focus as well as a few others who have fallen off our radar for a time but who have now caught our attention:

We always get a kick out of the melodramatic names these groups give themselves.

Beattie Troubles and Where Have the Boneheads Gone?

Hey, remember John Beattie? Of course you do if you're a reader of this blog or if you are at all interested in the history of the Canadian racist movement.

It appears that someone has made a complaint against Mr. Beattie and he's a little concerned about it now:


In fact, Beattie spoke about this on his really bad Internet radio program the same day he posted his last request to Dan Martin or, "OdinPatrick" as he was known on Stormfront.

Normally we wouldn't provide the link, but we'll make one of our rare exceptions in this case.

We sort of view Paulie as more of a clownish figure in the Canadian, "White Nationalist" movement, however we have German friends (and by this we mean both German-Canadian as well as Germans and Austrians) who are very frequently annoyed with him.

Mostly because of things like this:

Except in Paulie World when he is trying to pander to the pro-Nazi crowd.

Hate crimes charges laid against 3 teens

Vandalism and hate crime charges have been laid against three male teenagers in the spraying of racist and obscene graffiti in the Halifax area in August.
The RCMP said Tuesday that several homes in Eastern Passage were targeted with graffiti in August.

The teens are also accused of spray-painting the side of a house, vandalizing a post office box and defacing municipal signs.

An elementary school and a ball field were also vandalized during the spree, most of which occurred on Aug. 2 and again on Aug. 15.

Paulie Quite Inadvertently Stumbles Upon the Truth

Well it's that time of year when Doug Christie hosts yet another misnamed George Orwell Free Speech Award Dinner (misnamed not in the sense that Orwell opposed freedom of speech, but in that as a committed socialist opposed to totalitarianism in all it's forms, he would likely be disgusted that his name was being used to honour people who share the same ideology he risked his life opposing during the Spanish Civil War). Past, ehem... winners of this, uhm.... prestigious award include Marc Lemire, Ernst Zundel, Paul Fromm, Doug Collins, James Keegstra, Malcolm Ross and, our good friends and faithful readers, the Fourniers, among others.

Ernst Zundel Fire Revisited

On May 8, 1995, Holocaust denier Ernst Zundel was the victim of an arson attack on his Carlton Street home (known as, "the Bunker") which resulted in substantial damage. The only group to claim responsibility for the arson was an extremist group that had been linked to the Jewish Defence League, though the group in question actually hadn't been active in close to two decades.

Not long after, it began to be circulated in neo-Nazi and racist circles that the ARA had been responsible for the crime, a charge that has been repeated (without any evidence to support the accusation) for the past 16 years. In fact, as we point out in our recent timeline detailing some of the bonehead violence during the past 20 years, it is one of the three claims that Free Dominion brings up in their effort to paint the ARA (and, because we are focused on fighting racism as well, us too) as violent terrorists.

Well, one of our readers noticed this and sent us an article that this individual had saved concerning the accusation. In short, that dog don't hunt:

Facts Schmacts! Paulie Continues to Play Fast and Loose With the Truth: Part II

Time for more true facts that are completely accurate and truthful from Paul Fromm:


Aside from the fact that Paulie appears to believe that gang rape is a subject that people should find humorous and as a source of ridicule (see #2), he does hit on all the areas designed to enforce the otherness of non-Europeans:

1. Proclaim that the information he has posted is true.
2. Sets it in Detroit, a city with a high percentage of African-Americans.

 
3. Includes names which Paulie believes are stereotypically African-American.


4. Provided information that reinforces the perception that African-Americans are promiscuous.

 
5. Ends with a moral lesson that, "these people are not like us and 'we' hard working, moral White folks are supporting these inferior baby factories."


Yep, all the ducks in a row and confirming, in the minds of Paulie and all the bigots who agree with him, everything they already believe about people of color.

Then again, there might be a few problems with his claims here. Let's take a look again at what he posts as truth (which he also posted on White News Now):

Ian Verner Macdonald and Doug Christie Appeal Unsuccessful

The CBC and Mr. Kinsella successfully defended themselves against Ian Macdonald's appeal of his unsuccessful libel action against them. Kinsella wrote on his blog that the Ontario Court of Appeal listened to Christie, but didn't ask to hear from the CBC's or Kinsella's lawyers. The Court then upheld the costs of $180,000 and added another $25,000 for the appeal.

We might suggest that Macdonald quit while he's.... well.... not ahead, but before he falls even further behind.

A History of Violence: 1960 - 2020

Well, here it is. We think that most will agree that this will be the best article posted on the blog, or at the very minimum the most informative and perhaps most useful.

The following is a living document. We will continue to add information as we continue our research and as new incidents occur. We encourage our readers to help us in this project. If you are aware of an incident that can be backed up with secondary sources, please share those incidents with us for inclusion in the timeline. These include any incidents that occurred before 1989 as well (we can, and have, change the title to fit the information). If you are unable to provide a secondary source for the incident you shared with us, we will try to do so ourselves.

We have Mark Fournier of Free Dominion to thank for this article. On June 28, 2010, Mark Fournier posted a lengthy piece concerning his take on the G20 fiasco in Toronto. While we have the entire missive saved, here is the relevant section that concerns us:


To keep this in context, 20 years prior to Mark Fournier having written this claim concerning ARC being responsible for, "almost every incident of serious political violence in the past twenty years," in Canada, the then eldest member of the Collective was 13 years old and living in a relatively isolated farming community two hours from the nearest big city. The author of this timeline was 7 years old. 

Since then Mark has continued to make this claim against ARC and the ARA, as well as continuing to claim that ARC and the ARA are the same organization:

 
 
We've gotten used to ARC and the ARA being claimed as being one and the same and while we have a good working relationship with ARA chapters, we are indeed different groups that have different methods. But even still, when Mark claims that ARC/ARA members are responsible for most of the political violence for the past 20 years, we began to wonder what that actually looked like.

If we exclude the histrionics (claims of forcible confinement, for example, which is laughable), Mark and the Free Dominion crowd have only three incidents that they keep talking about to prove that the ARA (and apparently ARC) are violent, organized, criminal terrorists:

1. An attack on Garry Schipper's rented home by some protesting the Heritage Front's propagandist. This is the one claim that at least has some basis in legitimacy.
2. The firebombing of Holocaust denier Ernst Zundel's Toronto home. In fact, the only group that claimed responsibility was a small Jewish extremist group that had been linked to the Jewish Defence League.
3. A fight between young ARA members and a group of neo-Nazis that left one person fighting for his life. Even  Mark admits that it was the ARA member who was stabbed and almost killed and the bonehead charged with attempted murder, though he and others then claim he had it coming.

That's it. In 20 years, Mark was able to come up with three incidents, one of which resulted in no serious injuries to the boneheads but left an ARA member in critical condition and one in which the only people still claiming an ARA link (the firebombing) are those associated with the boneheads. If they are trying to be a violent group of Canadian terrorists, the ARA are really, really bad at it. 

Mark's statement did get us to thinking though while we sat around having a few beers. If we were to look back at the past 20 years, what would the level of bonehead violence look like? We figured that the numbers would be pretty high, but in all honesty most of us were too lazy to actually do the necessary research. Except for one of our members who did just that.

When "NomDeGuerre200" considered the question and suggested an article, the rest of the Collective had no idea how much research the author would engage in nor the level of information provided. 'NomDeGuerre200" made a point of only using information that could be verified by reliable secondary sources, mostly media based. We know there is more out there, but what has been created is, we believe, the most extensive timeline of neo-Nazi/racist violence in Canada covering more than 20 years (and as we will continue to add to the document, both before 1981 (we originally began at 1989) and after 2011, the list will no doubt become even more comprehensive).

What Does Richard Warman Do With the Money He is Awarded?

Why We Call Them Boneheads Part Infinity

Just a quick update that the article we alluded to in our last post is still having the final touches completed and will be up shortly. Those who have an interest in what this blog covers will appreciate the research that it involved.

We're sure that many of our readers know about Ivan Pavlov, or at least his famous experiment testing classical conditioning:


Classical conditioning (also Pavlovian or respondent conditioning, Pavlovian reinforcement) is a form of conditioning that was first demonstrated by Ivan Pavlov (1927). The typical procedure for inducing classical conditioning involves presentations of a neutral stimulus along with a stimulus of some significance, the "unconditional stimulus." The neutral stimulus could be any event that does not result in an overt behavioral response from the organism under investigation. Conversely, presentation of the significant stimulus necessarily evokes an innate, never reflexive, response...

The original and most famous example of classical conditioning involved the salivary conditioning of Pavlov's dogs. During his research on the physiology of digestion in dogs, Pavlov noticed that, rather than simply salivating in the presence of meat powder (an innate response to food that he called the unconditional response), the dogs began to salivate in the presence of the lab technician who normally fed them. Pavlov called these psychic secretions. From this observation he predicted that, if a particular stimulus in the dog's surroundings were present when the dog was presented with meat powder, then this stimulus would become associated with food and cause salivation on its own. In his initial experiment, Pavlov used a bell to call the dogs to their food and, after a few repetitions, the dogs started to salivate in response to the bell.

If Pavlov were alive today he might well reproduce his experiment using boneheads, though instead of using a bell to induce salivation, he could just utter the word, "Jew" and watch the conditioned response of  hate and stupidity.

We enjoy receiving fan mail, and by fan mail we mean rambling, barely-coherent temper tantrums posted by boneheads who while hating us always find time to read our blog. This most recent piece was left to us from someone who believes we have been unfair to Rob Reitmeier.

We would like to once again stress that we have not changed a single word this individual's missive:

you do realise you people are fucking retadrded rigth?....just because Rob was apart of this, doesn't mean he chose it... he was actually a REALLY good guy....get passed the racism and the drinking....and he was the biggest teddy bear...i should know i was his friend for the longest time...and an occasional buddy for other things...you have to realise just because he had tattoos and a bad attitude....doesn't make him any less of a human being then you or i.... and what about the rest of the W.E.B members...like that kevin kid....At least ROB didn't beat women... think about that...Rob was actually able to say "i love you" you guys need to realise SKINHEADS ARE JUST PEOPLE WITH BAD TEMPERS!

October Bits and Bites: Goudreau, Ontario Election, Ed Kennedy and Blood & Honour

We received a bit of fan mail regarding one of our recent article that dealt with the sentencing of two men involved in a mini hate crime spree in Edmonton earlier this year:

Great intel guys. Kyle wasn't even there that night. You think you're so fucking smart because you pulled the picture off of Kyle's facebook photos. Nice try, who's the bonehead now? 

Oh you! Of course you're right. At the time these boneheads were engaging in behavior that would end getting them sentenced to a lengthy stay in jail, McKee was (for not even the first time) a guest of the Canadian judicial system, at taxpayer's expense. This Represents the Reality of the "White Nationalist" Movement in Canada

We once decided that we were no longer going to write any articles about Kevin Goudreau because even in the, "White Nationalist" movement, he is a pariah. Sure, we alluded to him euphemistically, but it wasn't even sporting to make fun of him anymore. Then, the "National Post" inexplicably decided to make him the face of the fascist movement in Canada.

So, here we are.

But you know what? Covering Goudreau here actually has been very useful since it has shown us yet again how polarized the movement is in the country.

After the "National Post" article came out, Goudreau's ego had, as expected, exploded. And he actually tried to present himself as somewhat of an intellectual.

It couldn't have lasted and boy, oh boy, did it blow up.

Facts Schmacts! Paulie and Friends Continue to Play Fast and Loose With the Truth


Well, it really didn't take Paulie long to comment on the racial taunting incident in London, Ontario:


We were surprised that he would take this position on the fine city of London, as one of the more infamous residents has claimed that the city is as close to a "White Nationalist" utopia that one can find in Ontario:


My, my, who to believe? London as the promised land or London as a den of perverse iniquity?

How about London is a growing city that is very safe but which has it's share of crime like any other city in Canada? Yeah, that makes more sense.

Paulie really will make things up, or promote people who make things up, in order to try and convince people (mostly those who have already drunk the Kool-Aid) of the correctness of his views. Yet another example of this dishonesty is a post on "White News Now" in which he presents the view of the individual slamming Canada:


Paulie writes that, "Mr. Newton makes some powerful points." Just how powerful are these points when you actually take the time to dust off your critical thinking skills and perform a modicum of fact checking?

Blood & Honour Canada News: David Goodman and James Brooks Sentenced

Hey, remember last March shortly before the epic failure (which, in Paulie's mind, makes it an unqualified success) that was Blood & Honour's "White Pride Day" march? Four members/associates of Blood & Honour in Edmonton had been handing out flyers promoting the event, after which they decided to have a little fun, by which we mean harassing people and attacking people, including women.

One, James Brooks, claimed the story was blown out of proportion and that he was just misunderstood:

Guilty by association is always the case. A horrible night in which I am now deemed something that I am not by a night of drunken stupidity by me and some newly acquainted individuals, of whom I decided to partake in drink with. Then we have the twisted facts and over embellished stories by the media and others there due to what was said.

Those responsible were caught. Today two, including Brooks, pleaded guilty and were sentenced to lengthy jail terms:
