The complaint, brought under s. 13 of the Canadian Human Rights Act (www.chrc-ccdp.ca/discrimination/watch_on_hate-en.asp) was filed in December of 2004 and dealt with hate propaganda posted by Mr. Donnelly to a US neo-Nazi website that attacked Jews, gays and lesbians, Chinese, blacks, Hispanics, Aboriginals, and the mentally disabled. A subsequent complaint that was also included in the mediated settlement addressed Mr. Donnelly’s illegal retaliation against Mr. Warman after the filing of the original human rights complaint.
Given the attacks on the Aboriginal community raised in the complaint, Richard is donating the bulk of the money to a memorial education fund for the children of Kelly Morrisseau, an Aboriginal woman whose 2006 murder in Gatineau Park, Quebec remains unsolved. Richard is already one of the backers of the reward fund established by the Assembly of First Nations in this case. For further information, see:

Add Ciaran Donnelly to the list of Canadian neo-Nazis that Richard Warman has effectively dealt with. Donnelly and Warman have come to a mediated resolution in Warman’s human rights complaint against Donnelly who posted as Der_Totenkopf on Stormfront, Blood and Honour and other Internet hate site forums. As part of the resolution, Donnelly is required stop posting hate propaganda online and to desist from further retaliation against Warman, permanently close his Stormfront account and request that all his past posts be removed, and finally to donate $1000.00 to the charity of Warman’s choice.

Game. Set. Match. In a battle of wits, the far right in Canada appears badly outgunned.
Donnelly had a long history of involvement in neo-Nazi movements beyond his participation in Stormfront. He is a close friend of Glenn Bahr and was an early member of Bahr’s Western Canada For Us . Donnelly was also a promoter of Blood and Honour, associated with Todd Conroy and other members of Volksfront Canada, and more recently has been the guest of the Aryan Guard at private events such as a December 2007 Christmas party.
When Warman filed his complaint with the Canadian Human Rights Commission concerning Donnelly and his girlfriend Jessica Beaumont’s posting of hate propaganda online, Donnelly, in his infinite wisdom, retaliated by making veiled threats and photoshoping the picture of a church sign to read, “The Church of Dead Warman.” None to bright. However, by coming to a mediated resolution, Donnelly fared much better than his now fiancĂ©e Jessica Beaumont.
It would seem that Warman isn’t very concerned about Marc Lemire’s court challenge disputing the constitutionality of the Canadian Human Rights act as he continues to rack up victory after victory against a beleaguered neo-Nazi movement in Canada.

The Canadian Anti-racism and Education Society (CAERS) congratulates Ottawa human rights lawyer Richard Warman on the successful mediated resolution of his federal human rights complaint over Internet hate propaganda posted by Ciaran Paul Donnelly of Coquitlam, BC. The settlement is the third mediated case for Mr. Warman involving Internet hate propaganda and he has successfully litigated 10 others in cooperation with the Canadian Human Rights Commission.
The terms of the negotiated settlement are public and include the following:
i) the settlement will be registered with the Federal Court and prohibits Mr. Donnelly from posting further hate propaganda to the Internet or engaging in further retaliation against Mr. Warman
ii) Mr. Donnelly has agreed to permanently close his account on the US neo-Nazi website through which the hate propaganda was distributed and request that his postings be deleted
iii) Mr. Donnelly has paid damages in the amount of $1,000 for his illegal retaliation against Mr. Warman and at Mr. Warman’s suggestion, all of this money has been donated to charity or non-profit organizations
Richard has informed CAERS that the funds noted above will largely be donated to two charity/non-profit groups. The first is CAERS to help support our international work in fighting Internet hate propaganda through our membership in the International Network Against Cyber Hate (www.inach.net).

ReplyDeleteThe title of this article is rather over-embellished. Cairan has to pay a mere $1000 and quit posting "Hate" on the internet. Is that what is considered to be a great victory over hate mongers in Canada?
ReplyDeleteCiaran may have perhaps won the battle by settling out of court, thus saving himself thousands more of money he doesn't have.

ReplyDeletePoint taken, but the $1000.00 fine is simply a small part of the larger issue. In our mind the part of the ruling that was a victory was that Donnelly would stop posting hate propaganda online in exchange for a much more lenient settlement. In addition, the small monetary and the fact that it's being donated to charity flies in the face of the argument that these complaints are being used to enrich Warman (I suspect that he likely spends more than he recuperates). Finally, this, as well as the Elizabeth Lampman mediated settlement defies the argument that Warman is out to destroy people.
I agree with your statement. This action (of Richard) hardly makes him out to be a "monster", as what most websites and even some news programmes state.
ReplyDeleteOf course Ciaran could still post on hate sites, using other(s) computer and not revealing his real name. According to some websites, Ciaran seems to have falling into bad health, it is good to see Richard Warman has some compassion, even when dealing with his political adversaries.
